Terms & Conditions

Location X UK Ltd provides location research, scouting, management and production. These services are offered to you conditional upon your acceptance of our Terms and Conditions of Business. Your confirming a job (by email, Purchase Order or verbally) constitutes your acceptance of these Terms and Conditions. If you do not agree to be legally bound by these terms, please do not use our services. Our Terms of Business may change from time to time; you are advised to check each time you use our services, as you will be bound by the Terms and Charges that apply on the date of confirmation.

Definitions

• "The Company": Location X Ltd,. the appointed agent of The location owner, or any of its associated or subsidiary companies.
• "Library": the library and web library of Location X Ltd
• "Location": the premises or land which is made available for hire;
• "Client": any company, individual or third party utilising any of the services provided by the Agency;
• "Owner": the individual, company or legal entity which owns, controls or represents The location;
• "Charges": the fee for any work which may be chargeable by The company to the Client and/or Owner;
• "Recce":-  a "reconnaissance" visit to The location by the Client or his/her representatives;
• "Shoot": the use of a Location by the Client, whether for the purposes of filming, photography, or any other kind of event.

Data Protection

The company maintains databases which are subject to the provisions of the Data Protection Act 1998, The Agency will make every reasonable effort to ensure the security of the owners’ and clients’ details.

License

Images downloaded from the Location X Ltd Library and/or any other images/material supplied to the Client by The company may be used for reference only, and may be printed for private, non-commercial use only. No user of the services may copy, reproduce, publish, or transmit any section of the Library or any other supplied images or materials in any way, without The company's prior express permission. No user may edit or alter or crop any of the images supplied or downloaded from the Library. All images and information supplied are copyright Location X Ltd, unless otherwise indicated. All users must agree to use any supplied material only for lawful purposes.

Charges

There is no charge for using The company's web site(s), nor for initial enquiries, advice etc. Location X Ltd will provide a formal estimate for services to be undertaken. On confirmation of receipt of estimate the Client will accept or decline services. On acceptance of written confirmation, brief and Purchase Order where appropriate, Location X Ltd will be obliged to undertake work estimated according to Client’s brief.  Agent’s fees & expenses must be paid within 14 days of receipt of Location X Ltd Invoice. All overseas and most UK clients will be required to pay 50% of total estimated fee upfront before work commences and the full amount invoiced to be paid upon completion. The location hire fee is separate, and subject to negotiation. Location Fees and costs associated directly to the location/shoot dates must be paid by the Client in advance/at the time of the shoot. Overtime payments (if applicable) will be invoiced after the Shoot, and must be paid within 7 days. Additional charges may include a damage deposit which will be held until after the Shoot. Preparation and reinstatement days are normally charged at 50% of the agreed Shoot fees. Outstanding sums due to the Agency and/or Owner will carry interest in accordance with UK Late Payment of Debts legislation. On confirmation, any job cancelling less than 48hrs before the agreed first day of work will attract a 50% cancellation fee of estimate provided.

Warranty

Although every effort has been taken to ensure the locations presented are available in principal, no warranty is given or implied that any Location is available or suitable for the Hiring. The display or provision of images and/or particulars do not constitute any part of an offer or contract and are for guidance purposes only. None of the descriptions in any private collection, nor those provided by a location scout or librarian may be relied upon as statements of fact unless specifically presented as checked.

Services:

Services provided by Location X Ltd are defined as the following:

Location Research – Location X Ltd will endeavour to provide location research and images using internet/phone and database information available to Location X Ltd. Images and information provided by Location X Ltd to the Client may be subject to third party terms and conditions. Images and information provided to Location X Ltd may not always be accurate or up to date and are intended solely to provide a sense of what Locations may be available. Location research is intended as initial step within Location Scouting service and is recommended by Location X Ltd before Location Scouting commences. Location X Ltd will advise length of Location Research needed specific to each individual brief.

Location Scouting – Location X Ltd will endeavour to find locations according to brief provided by Client within the timescale agreed. A full and accurate Brief must be provided at least 24hrs before Scouting commences, or Location X Ltd cannot guarantee an effective scouting service. Any change of brief must be notified in writing to Location X Ltd at least 24hrs before Scouting commences. Location Scouting photographs provided by The company to the Client must not be used to any other purpose than reference for the shoot to which the Client has employed the services of Location X Ltd.

Location Management – Location X does not own the locations it puts forward for a shoot and is therefore not in complete control of them. While we will do our best to protect the client against the changing priorities of Location owners, and to anticipate any problems likely to present themselves on a shoot, it take no responsibility for the unpredictable changes that can occur on location. Location X Ltd recommends the Client employ a Location Manager to supervise the Shoot, its preparation and to assist with all location based queries and concerns.

Production Services – Location X will use its experience and know how to reduce the possibility of poor research by its recommended associates to a minimum. It does not however accept any responsibility for any loss, damage or penalties incurred by these third party individuals or companies.

"Recces"

The company highly recommends that a recce take place so that the Client can establish for themselves the suitability and condition of The location. It is the responsibility of the Client to ascertain the status of The location and its suitability, and to ensure that all necessary permissions are in place prior to the commencement of the Shoot unless Location X is specifically briefed to manage the location shoot and its prep. Neither The company nor the Owner can accept responsibility for loss, damage or inconvenience that may occur when no Recce takes place. At the time of any such recce, the Client assumes full legal responsibility for equipment and/or personnel that enter The location.

Public Liability

All Location Hire is subject to contract, and the Owner reserves the absolute right to refuse the booking without giving a reason. The Client must exhibit proof of Public Liability Insurance prior to entering the Premises for the purposes of the Shoot.

Disclosure

Where details are given for a particular location, whether used or not, any subsequent use of that location by the Client, the location manager, production company or its principals will be charged at normal library rates and will be subject to these same Terms and Conditions. The cancellation of the booking followed at any time by the subsequent use of The location will be subject to the usual booking fees. The booking fees apply to one usage of The location: subsequent usage will be subject to additional booking fees. All location contact details and information released by The company to the Client are confidential and shall be used for the purposes of the production only and may not be released to any third party under any circumstances unless specifically necessary for the purposes of the production. "Recce photographs" taken by a Client, or their representative, who visits a supplied location are for reference use only, and for the sole use of the production for which they are taken. Such recce photographs and/or any other reference material, including contact details, must not subsequently be used for financial or personal gain.

Liability

Location X highly recommends that a qualified Location Manager be employed by the Client to oversee the Shoot, to organise access, parking, permissions and responsible care of The location. Responsibility for the notification of relevant authorities, and the notification of neighbours, entirely rests with the Client. The company will not be liable for any loss or damage suffered as a result of the Hire. The total extent of any liability shall in any event not exceed the total of the Charges and/or Commission if applicable.

Abusive clients & owners

Location X Ltd is committed to providing the best possible service to its clients, however testing the circumstances but will not tolerate abusive or threatening behaviour from its clients or location owners. The company reserves the right to cease all further business dealings with any of its clients or suppliers, and to cancel any hiring immediately and without recourse or appeal.
